This agreement is governed by the laws of the Sultanate of Oman and disputes are subject to the competent courts of Muscat.

Mobile App End-User License Agreement

This End-User License Agreement ("EULA") governs your use of the oFatoura ePOS and oFatoura Partner mobile applications (each an "App", together the "Apps") provided by Async Solution Services LLC ("Async Solution", "we", "us", or "our"). The Apps are professional tools for restaurant staff and operators and are not consumer applications. By installing or using an App, you agree to this EULA, which supplements our Terms of Service.

1. License grant

Subject to your compliance with this EULA and an active oFatoura subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps on devices you own or control, solely for your internal business operation of the oFatoura Service. The license terminates when your subscription ends.

2. Eligibility and accounts

You must access the Apps using credentials issued through your oFatoura account and keep those credentials secure. You are responsible for the activity of staff who use the Apps under your account.

3. App-store terms

Your download and use of the Apps are also subject to the terms of the store from which you obtained them (the Apple App Store or Google Play). Where the App is obtained from the Apple App Store, Apple is a third-party beneficiary of this EULA and may enforce it. The Apps are not affiliated with, sponsored, or endorsed by Apple or Google, who are not responsible for the Apps or for support of them.

4. Device permissions

The Apps may request device permissions only as needed to function, including:

  • Network access — to sync orders and data with the oFatoura Service.
  • Notifications — to alert staff to new orders and operational events.
  • Local network / Bluetooth (oFatoura ePOS) — to discover and connect to receipt and kitchen printers.
  • Camera (oFatoura ePOS) — to scan QR codes and barcodes.

You may manage permissions in your device settings, though disabling some may limit functionality.

5. Data and privacy

Our handling of personal data through the Apps is described in our Privacy Policy. Data is hosted within the Sultanate of Oman.

6. Acceptable use

Your use of the Apps must comply with our Acceptable Use Policy.

7. Updates

The Apps may download and install updates automatically to improve security, performance, and functionality. Some updates may be required for continued use.

8. Intellectual property and restrictions

The Apps and all related intellectual property are owned by Async Solution or its licensors. You must not copy, modify, distribute, sell, sublicense, or reverse engineer, decompile, or disassemble the Apps except to the extent permitted by law.

9. Disclaimers and limitation of liability

The Apps are provided on an "as is" and "as available" basis. To the maximum extent permitted by Omani law, our liability in connection with the Apps is subject to the limitations set out in the Terms of Service. Nothing excludes liability that cannot be excluded under the laws of the Sultanate of Oman.

10. Termination

This EULA and your license terminate automatically if you breach it or when your oFatoura subscription ends. On termination you must stop using and remove the Apps from your devices.

11. Export and legal compliance

You must use the Apps in compliance with all applicable laws of the Sultanate of Oman, including any export and technology-use restrictions.

12. Governing law

This EULA is governed by the laws of the Sultanate of Oman and disputes are subject to the competent courts of Muscat.
